AFFICHEEXPERT.CA/9387-2935 QC INC (hereinafter referred to as THE COMPANY) GENERAL CONDITIONS AND TERMS OF OPERATION
The following terms and conditions apply to all orders placed with WWW.AFFICHEEXPERT.CA
1. SUBMISSION
1.1 - For any submission request, you must send a request by email to info@afficheexpert.ca
Response times vary from 1 to 3 business days. The prices indicated in our quotes are based on the cost of paper and may change without notice after 30 days, from the date of creation of the quote.
1.2 - Quotations are based on regular hourly rates of pay
1.3 - Quotations are normally based on continuous and uninterrupted delivery of the entire order. However, in the event that an order is filled over an extended period of time, either as a result of delays attributable to the customer or because of the nature of the work itself, then the customer agrees that the printer may, at its option, increase the price in proportion to any increase in wages and/or material costs.
2. COMPUTER GRAPHICS, COLORS AND OTHERS
2.1 - THE COMPANY does not prepare any color proofs other than an on-screen approval when placing the order on our website for "combo" type cartons. If the customer does not fill out the order, they will not be able to approve the proof. Therefore, the person who fills the order for him will approve the proof on his behalf and the customer will have to accept the order as is. Screen proofs are not used for color approval, but only for dimensions, texts and logos and/or images.
If the customer wishes, an EPSON proof can be prepared for certain products at a cost of $30 + taxes, if requested by the customer, BEFORE placing the order. The EPSON proof is the only way to guarantee the accuracy of the colors.
Also, please be aware that the grain direction in the media used is never guaranteed in any of our products sold on the website AND it is not guaranteed for orders coming from submission UNLESS clearly indicated.
The time frame in which these cartons are produced does not allow THE COMPANY to wait after a customer's approval is returned.
2.2 - For any other type of printing, a minimum charge of thirty dollars ($30) may be applicable for a set of proofs and may even be required by THE COMPANY before putting the job into production, especially for large quantity orders.
2.3 - THE COMPANY is not responsible for computer graphics errors on artwork that is approved by the client and on any artwork that comes from your own designer. This includes problems with pixelation (sawtooth) on layouts, transparency, overprint, choice of CMYK or PMS color mixes, spelling, etc.
CAUTION: We suggest that you use the OVERPINT PREVIEW option of your computer graphics software before submitting your document in order to see the final result of the work and to prevent problems due to a bad overlay of your images/texts. If you provide a vector EPS file, it will be preserved, but if you provide Photoshop files, it will be normal that your fonts, especially the very small ones, will be less beautiful when printed.
2.4 - The colors can vary at the time of printing, which is normal in CMYK process. Therefore, the accuracy and uniformity of colors cannot be guaranteed unless the customer has taken an EPSON PROOF before the order. For any digital proof or screen PDF, THE COMPANY will not be responsible for the final result.
2.5 - THE COMPANY does not undertake to do any work until the electronic files have been checked and accepted. THE COMPANY will not be responsible for any problems with the files, if any.
2.6 - Due to differences in equipment, paper, inks and any other conditions between the color proof and the print room production operations, a reasonable variation in color between the color proofs and the printed work constitutes acceptable delivery.
2.7 - Charges for modification of non-conforming files:
RGB to CMYK conversion: $20.00 + tx
Adjusting the format of a file: $20.00 + tx
Adding bleed to a file: $20.00 + tx
All other modifications will be charged at $70.00 per hour for a minimum of one hour. We will still take the time to notify you when your files do not meet the technical specifications. If time permits, it will be possible for you to send us a new visual to avoid the cost of making adjustments.
2.8 - CAUTION
Be aware that computer monitors work in RGB mode and project light, unlike a CMYK print, whose pigments reflect a spectrum of light that allows you to see the colors. Therefore, even if your monitor is calibrated, it is impossible to guarantee that the colors on the screen will be exactly the same as those that will come out in the print shop. Please do not rely on your home printer either. No matter what the advertisement says or how much you pay, no home printer can produce the same results as the ones we use.
2.9 - For any unvarnished print job, be aware that dark colors on one side may smear if the reverse side is white or very light. If you have a side of your board that is white, the dark ink from the front side may transfer to the white when cutting and especially around the edge, where the knife blade applies most of its pressure when cutting. Therefore, this problem is not guaranteed by THE COMPANY and no job refused under this pretext will be credited or reimbursed; furthermore, for any job without varnish and for which there is a fold to be made, if you do not pay for the option of scorching on the job, THE COMPANY disclaims any responsibility for the possible cracking of the ink and the paper in the fold line.
2.10 - For certain combo print products, please note that quantities of five hundred (500) copies and less can be printed digitally without varnish, while quantities of more than five hundred (500) copies are printed in traditional press.
2.11 - For any job with matte or gloss lamination, the latter may affect the colors slightly, darkening the mix a bit and adding a slight yellowish tint, due to the glue that is applied at the time of lamination. It is therefore possible that there will be a slight difference between your final result and your proof (if you have approved one), because your proof will not be laminated, but your print will.
2.12 - For all printed and/or cut vinyl jobs that require installation, including but not limited to wall decorations or vehicle lettering, our warranty is 30 days on printing or vinyl defects only; we do not offer installation service and therefore we are not responsible for any problems or defects related to vinyls due to mishandling during installation or any other installation defect.
2.13 - To be sure that your mounts will be in compliance, we recommend that you read the technical specifications section.
2.14 - Electronic file: the customer is responsible for keeping a copy of his original file. THE COMPANY is not responsible for any accidental damage that may occur to the documents provided by the customer.
2.15 - Computer Graphics Service: The COMPANY offers a computer graphics service. A minimum fee of thirty dollars ($30) is applicable for any design or graphic correction if necessary. Thereafter, a rate of $70/hour applies. If the work has to be done in a shorter time frame, on vacations, evenings or weekends, the hourly rate can be doubled, at the discretion of the printing company.
Sending final files, one week after approval, will incur a charge of ten dollars ($10.00) per file with a minimum charge of thirty dollars ($30.00), for archival research, file compression, emailing and/or burning to CD or USB drive. No files, sources or working documents used to produce the final file or product will be sent to you, as they are the exclusive property of the printing company. Only the final files will be transmitted to you.
2.16 - THE COMPANY reserves the right to indicate its name, URL or any other similar information to indicate the source of its products when printing a poster, unless the order expressly states otherwise. Standardized posters are generally marked with COMPANY's URL.
3. FINISHING:
3.1 - Bundling of 100: The process used to make the bundling of one hundred (100) does not allow us to guarantee the accuracy of the quantity of each package. Therefore, the content of the packets may vary slightly between ninety-seven (97) and one hundred and three (103) units on average.
3.2 - For all jobs done in digital printing and/or in combo, it is impossible to guarantee an equal framing on all 4 sides of your job. We are talking about orders that must have equal white (or color) registration on all 4 sides of the job. If you wish to have exact framing, you must opt for a non-combo/digital job so that we can give your file the required attention.
4. DELIVERY AND DISTRIBUTION
4.1 - A delivery service is offered, for a fee that varies according to the distance involved. This delivery is provided by a courier company that cannot guarantee that all packages will be delivered the same day.
4.2 - Combo products requiring a particular finish such as glossy lamination, scorching, folding, perforating, numbering, die-cutting or other, require a longer production time and therefore, the above mentioned delays do not apply.
4.3 - No delivery or pick-up will be made on weekends. If you are absent at the time of delivery, the delivery charges remain applicable. During normal business hours, any other delivery will be made, at your request, by a courier company whose charges will be added to your invoice.
4.4 - CAUTION
Although promised in good faith, the delivery date is not guaranteed and the seller cannot be held responsible for damages caused by any delay. This also applies to cases of force majeure (e.g. machine breakdown, strike, natural phenomenon, power failure, etc.)
4.5 - Deliveries made by an external courier service. External delivery company: any delivery company or courier service that is a third party. COMPANY INC. is not responsible for delivery delays caused by any external delivery company. However, THE COMPANY will initiate search and claim procedures in the event that a package is lost by an outside delivery company. Lost orders will not be reprinted until the outside delivery company confirms the loss of the packages and compensation is guaranteed. The customer may have the lost order reprinted at the customer's expense pending confirmation and compensation from the outside shipping company. A credit will be issued to the customer's account when the search and claim procedures are completed.
4.6 - The mailing service offered by THE COMPANY exists solely to provide the customer with a turnkey service. In no case can THE COMPANY be held responsible for problems or delays in distribution by Canada Post. For addressed mailings, the customer must take the time to verify the addressed documents before sending them to Canada Post. If the customer asks us to proceed with the mailing without verifying the addressing, THE COMPANY will not be held responsible for any errors or problems with the mailing.
In the event that a problem occurs with the printing of a job and the customer has not approved the addressing prior to mailing, THE COMPANY will agree to reprint and address the job at its own expense, but under no circumstances will Canada Post postage be credited or refunded to the customer. The customer must verify the work before mailing.
Under no circumstances will THE COMPANY be held responsible for any loss or damage to a shipment that is delayed, due to a necessary reprint or for addressing errors. Only reprinting and re-addressing will be covered by THE COMPANY.
5. PAYMENT AND CREDIT
5.1 - Types of payment: VISA, MASTERCARD, AMERICAN EXPRESS and PAYPAL transfer are accepted via our website. All orders are payable in full on order, unless you have an account with THE COMPANY.
5.2 - No shipment will leave the offices of THE COMPANY until the invoice is paid in full.
5.3 - Customers with a thirty (30) day account with THE COMPANY may pay by check. On some orders, a deposit may be required from THE COMPANY prior to production.
5.4 - A $30.00 fee is applicable for all NSF checks.
5.5 - For all new customers, the total amount of the invoice is required before starting production.
5.6 - Interest at the nominal rate of 26.8% (2% per month compounded monthly) applies to any amount not paid within thirty (30) days.
5.7 - In the event that the COMPANY delivers a partially or completely defective product to the customer due to problems unrelated to the customer, the COMPANY agrees to reprint the material, provided the customer returns the defective product to the COMPANY in full. In the event that a partial quantity of the material is deemed unacceptable by THE COMPANY, only that partial quantity will be reprinted and not the entire original order.
5.8 - No refunds will be made for any credit given to the customer. Thus, only a store credit, applicable on the next order, will be granted. To obtain a credit on an order with a problem or a manufacturing defect during delivery, this problem must absolutely be reported in writing (email or mail) within 30 days of the delivery date. The printing products that come with components such as retractable banners, Oriflammes, Signicades, banners and coroplast with eyelets and others are guaranteed for a maximum of 30 days from the date of delivery.
5.9 - ATTENTION:
In the case of a cancellation or modification of an order before it is put into production, we will not make any refund. Only a store credit, in addition to the charges listed in point 2.4 according to the terms indicated, may apply. Please be careful when making your choice of product on the site and make sure you put the right product in your cart.
6. PRICES AND DELIVERY RATES
Product prices and delivery charges are displayed in Canadian currency. They are subject to change without notice and do not include taxes.
7. PROMOTION
THE COMPANY reserves the right to refuse the application of any promotion at any time. Promotions are non-redeemable and non-exchangeable and may be changed or cancelled without notice. A promotion already applied to an invoice may be revoked at any time at COMPANY's discretion.
8. INDEMNIFICATION
The Customer shall indemnify and save harmless THE COMPANY from and against all losses, costs, expenses and damages in connection with any claim, demand, action and suit which may be brought against THE COMPANY on the grounds that the said print violates the copyright or property right of any person, or contains anything libelous or defamatory, or violates any person's right to privacy or any other aspect or element of his or her personal rights, except insofar as THE COMPANY has contributed to the matter. The Customer agrees to promptly defend and continue to defend THE COMPANY against any and all such claims, demands, actions or suits that may be instituted against it to THE COMPANY's full and complete exoneration, provided THE COMPANY promptly notifies the Customer, giving the Customer such reasonable time as may be necessary, depending on the exigencies of the situation, to diligently undertake and continue said defense.
It is the customer's responsibility to ensure that the display complies with all applicable laws and regulations before installing or using the products. THE COMPANY cannot be held responsible for the display or use of products in violation of any laws, regulations or other restrictions.
Occupational health and safety (OHS) products are intended to contribute to OHS policies that protect employees and the public, but the customer is responsible for ensuring that all OHS rules are followed in their workplace.
9. WAIVER
9.1 - Any waiver of these conditions must be supported by written confirmation signed by one of the directors of THE COMPANY. No oral agreement, change or modification of these terms and conditions shall be binding upon the Vendor unless confirmed in writing.
